Whitchurch, William 1769

William Whitchurch of Little Keyford in Frome Selwood, clerk. Dated 11 October 1768.

To my brother in law Zackary Bayly of Frome Selwood, gent. and John Stevens of Great Keyford in Frome Selwood, tanner, two parrocks on the other side of a messuage in Little Keyford heretofore in tenure of Clement Thatcher, now called Corn close, and two acres of meadow in a common mead called Swans Nest near Feltham, another acre and a yard of pasture in a common meadow near Quaking bridge, another acre at Buttle More, 1/2 acre shooting up to the highway that leadeth from Tytherington to Little Keyford, which premises are parcel of 25 acres of meadow formerly belonging to said messuage in parish of Frome Selwood. Also 24 acres of arable belonging to said messuage in the West field of Frome Selwood and in the field of Keyford consisting of various acres near Buttlemore upon and near Sunday Hill, near Beggars Bush shooting to the footway leading from Frome to Nunney on the north side of Keyford field shooting up to the Greenway that leadeth from Broadway to Adderwell, at Greenway shooting down the north side of it, near Adderwell, shooting athwart the way leading from Great Keyford to Feltham, near Feltham Hill, and upon Eddy Cleeves or any ground held by me in exchange for any part of said acres; and also a close in the possession of William Parsons and all other lands whereof I am seized in fee simple; To hold in trust to sell and to discharge a mortgage on the premises and my debts. To Zackary Bayly and John Stevens closes called Barn Close, Bushy Close, Griffin Grove, New Close, Hill Barrow in Frome Selwood now in tenure of Jas. Turk; to hold for residue of term of 500 years beginning about 4 November 1727 to sell for discharge of mortgage and my debts. All rents, stocks of cattle, household and other goods (except such provisions for housekeeping as shall be in my house or possession at the time of my death, which I give to my wife) to the trustees to sell and pay debts and with the overplus (if any) to pay L100 to my mother for her own use and Residue to my son on his attaining the age of 21 years and in case he dies before attaining that age to my wife for her own use. Cyder Press, Furnace and boiler not to be sold but to remain in the house as Heir Looms. If other lands and goods are sufficient to pay my debts, I give to my wife the following (household goods given in detail) with remainder after her death to my son, Zackary Bayly and John Stevens to be executors. Whereas previous to my marriage I agreed and have now settled the messuage in Little Keyford wherein I now live with the land belonging and also a messuage parcel of a farm called Barrow alias Great Barrow in Frome Selwood then and now in tenure of James Turk to use of myself for life with remainder to my wife for life, with remainder to all and every of our children in such proportions and manner as I should appoint and for want of such appointment to our children as tenants in common and if only one child to use of such child and heirs of his or her body or in default to use of my own right heirs. I now give all my aforesaid right in last mentioned premises so settled subject to expiration or aforesaid limitation and uses to my brother in law John Durnford, gent. for life and afterwards to the use of Elizabeth his wife my sister for life and after her death to their children and issue, with remainder to my right heirs.
