Whitchurch, Samuel 1721

In the Name of God Amen I Samuel Whitchurch of the Citty of Bristoll Tobacconist being somewhat indisposed in body but of sound and disposeing mind memory and understanding Do make and ordain this my last Will and Testament in manner Following First and principally I commend my Soul into the hands of Allmighty God that gave it And my body I commit to the Earth to be decently interred at the discretion of my Executors hereafter named And as touching my Worldly Estate I dispose thereof as Followeth Whereas I am seized in Fee simple of and in a certain messuage Tenement or dwelling house with its appurtenances in Temple Street in the said Citty of Bristoll now in the Tenures of severall persons as my under tenants which I bought and purchased of and from Matthew Warren Milliner Now I do give devise and bequeath the same with its appurtences unto my Son Thomas Whitchurch and to the heirs of his body lawfully begotten and to be begotten and for default of such heirs then I do give the same unto my Son Edward Whitchurch and to his heirs and assignes for ever Item I do give unto my said Son Thomas Whitchurch the Sum of one hundred pounds in money And I do forgive him all moneys he shall owe me at the time of my death by Bill Bond Note or otherwise Item Whereas I am possesst and interested for some terme or terms of years determinable upon lives of and in my messuage tenement or dwelling house wherein I do now inhabit and dwell Situate at or near Batthaven(?) in the Parish of Temple att Holy Cross within the said Citty of Bristoll now I do give devise and bequeath the same with all its appurtenances unto my daughter Elizabeth the Wife of John Rich Grocer for all my terme and interest therein that shall be to come at the time of my decease Item I do give and bequeath all my household goods plate Linnen and Woolen unto my said Son Edward Whitchurch and my said Daughter Elizabeth Rich equally to be divided between them Share and Share alike Item Whereas I am possessed and interested for some terme or terms of years determinable upon lives of and in a small messuage or tenement with its appurtenances in Temple Street aforesaid wherein James Tucker Tyler doth now inhabit and dwell Now I do give devise and bequeath the same unto my Servant Margaret Beaton Spinster for all my terme and interest therein that shall be to come at the time of my decease And I do also give unto my said Servant Margaret Beaton a Bed and Bedstead and the Furniture thereof whereon she usually lyes and Fifty Guineas in gold in consideration of her Faithfull Service for many years past Item Whereas my Son in Law Nathaniel Tilly Clothier owes me the Sum of twelve hundred pounds principall money on Mortgage of his Estate besides interest for the same to a considerable Sum and also severall hundred pounds more by Bills Bonds Notes and otherwise which I have advanced and paid for him to his Creditors Now I do hereby forgive unto him the said Nathaniel Tilly all and every the said severall Sums of money so due to me upon any account whatsoever except the said principall Sum of twelve hundred pounds which shall be taken as part of my residuary Estate Item I do give unto Nathaniel Mary Ann Elizabeth William and Gertrude Children of the said Nathaniel Tilly by my daughter Mary his Wife twenty pounds apeice Item I do give unto my Son in Law John Peach one hundred pounds in money and to his five children by my late Daughter Ann his deceased Wife Viz. Samuel Ann Elizabeth Mary and Sarah Peach I do give the Sum of One hundred pounds apeice to be paid to them respectively when he she or they shall attain their respective ages of one and twenty years or shall be married which shall first happen and if one or more of them dye before then the Legacy or Legacies of him her or them so dyeing shall go to the Survivors and Survivor of them and my Will and meaning is that their said Severall Legacies shall in six months after my decease be paid to their Father to be by him improved for their best benefit and advantage Item I do give unto my Grand Daughter Ann Whitchurch Daughter of my late Son Charles Whitchurch deceased the Sum of one hundred pounds to be paid at her age of one and twenty years or day of Marriage which first happens and in the mean time my Will is that my Executors shall put the same out at interest and apply the interest thereof for her better maintenance and Education but shall not be lyable for any loss that may happen by putting the same out Item I do give unto my Grand Children Francis Ann and Elizabeth Whitchurch Children of my said Son Edward Whitchurch and to Samuel Ann and Elizabeth Rich Children of my said Daughter Elizabeth Rich one hundred pounds apeice and to be paid them and the Survivors and Survivor of them to have the whole at their respective ages of one and twenty years or days of marriage which first happens Item I do give unto Mrs Elizabeth Whitchurch the Widow of my late Brother Mr Alderman Whitchurch tenn pounds for mourning And I do give unto Katharine Dessell Widow of Robert Dessell and to John and Mary her Children tenn pounds apeice And to Robert Smith Tobacconist tenn pounds And unto Charles Statam Carpenter I do give one Guinea and I do forgive him whatsoever moneys he shall owe me at my death Item I do give to the poor of the parish of Temple in Bristoll five pounds to be distributed at the discretion of my Executors Item I do give unto Thomas Jones Clarke of the said parish one Guinea in gold for a token Item all the rest and residue of my moneys Securitys for moneys Bills bonds Goods Chattles and personal Estate whatsoever and wheresoever my debts and Legacies being first paid and Funerall Expences discharged I do give and bequeath unto my said Son Edward Whitchurch and to my said Daughter Elizabeth Rich equally between them share and share alike and I do nominate constitute and appoint my said son Edward Whitchurch and my Son in Law the said John Rich to be joint Executors of this my last Will and Testament And I do revoke all former Wills and declare this to be my last Will and Testament In Witness whereof I have hereunto put my hand and seal this Seventh day of February Anno Domini 1720 Sam.
