Whitchurch, William 1720 *

I William Whitchurch of Froome Selwood in the County of Somerset Esq do revoke all former Wills by me at any heretofore made and do hereby declare my last Will and Testament to be as followeth Imprimis I give unto my Grandchildren Robert Whitchurch Elizabeth Whitchurch Mary Whitchurch John Whitchurch Rebecca Whitchurch Dorothy Whitchurch Anne Whitchurch and Joseph Whitchurch Eight Children of my Son William Whitchurch by Dorothy Whitchurch his now Wife and to each and every of them the Sume of five hundred pounds to be raised and paid out of my Mannors in Berrow in the said County of Somerset and out of all my Messuages Lands Tenements and Hereditaments in the several parishes of Berrow aforesaid and Brent and Burnham in the said County of Somerset to be levyed and raised by Sale or Mortgage of the —- or any part thereof or otherwise and paid to each and every of them as they and each of them shall severally attain their respective ages of one and Twenty years in case any or either of them shall happen to dye before he she or they shall have attained the said ages of One and Twenty yeares then the said Legacy or Legacyes of five hundred pounds given to him her or them that shall so dye shall (rescind) and abate and not be given? or paid which said Legacyes of five hundred pounds apeice given to my son Williams children I give to them in full satisfaction and discharge of all and every Covenant promise and agreement made by me and Mr. Robert Smith deceased late father of my said sons Wife or either of us in and by the marriage Articles of my said Son William with his said Wife and in full satisfaction of their share and proportion of all and every the Lands Tenements and Hereditaments thereon mentioned? or intended to be settled on the Issue of my said Son William by the said Dorothy his now Wife and my Will is that in case all my or either of my said Grandchildren shall sue molest or trouble the Heires Executors or —– of me or of the said Robert Smith or the eldest son and Heir of my said Son William Whitchurch or any or either of them for touching or concerning my covenant agreement or thing —– in the said Articles or others then the Legacy and Legacyes of him her or them that shall so sue molest or trouble their Heires Executors or Administrators of me or of the said Robert Smith or the eldest son or Heir of my said Son William Whitchurch shall go and be paid to such person or persons who shall be sued or suffer by such suite my Will and intention being that the eldest son of my said son William Whitchurch and his Heires shall hold and enjoy all the Lands and Hereditaments mentioned or agreed to be settled in and by the said marriage Articles or otherwise Item I give and devise unto my said Son William Whitchurch All those my Mannors in Berrowe aforesaid with their Rights members and Appurtenents within the Several parishes of Berrow Brent South Brent Burnham and Lympsham in the said County of Somerset with the appurtenantes To hold to him the said William Whitchurch my Son his Heires and Assignes forever charged and chargeable with the aforesaid Legacyes of five hundred pounds to his said children as aforesaid provided Alwayes and it is my Will that my Executor shall receive the Rents and profits of the aforesaid Lands to the Feast? of St. Michael the Archangell or the —– of the blessed Virgin Mary which shall first happen after my death and from thence my said Son to have the same and I do hereby charge and oblidge my said Son to confirme all such rents acts and agreements that I shall have made with any person or persons in my life time for any Lands or Tenements by Granting to such person and persons Leases or Coppyes thereof according to such agreement and that my Executors to be paid the money due on such agreements and my Will is that my said Son William Whitchurch and his Heires shall have full power from time to time to grant Leases and Coppyes for one two or three life or lifes or yeares determinable on one two or three lives of any the Messuages Lands Tenements or Hereditaments within the said Mannors or either of them reserving the ancient and —– yearly Rents or more which Leases and Coppyes shall be good and valid against the aforesaid Legacees his children but the money raised thereby shall be applyed towards raising the said Legacyes Item I give and devise unto my said Son William Whitchurch All my Messuages Lands Tenements and Hereditaments in the parish of Winborne in the County of Dorset to hold to my said Son William Whitchurch his Heires and Assigns for ever Item I give to my said Son William Whitchurch the Sume of one? hundred pounds to buy mourning for himself his wife and children Item I give my coppyhold Tenement in ?ington ___ William during his life and after his death to my daughter Phelps for her life Item I give to my said daughter and her —– children Ten? pounds apeice to buy their mourning Item I give unto my grandsons John Whitchurch and Samuel Whitchurch sons of my son John Whitchurch deceased the Sume of five hundred pounds apeice to be paid unto them respectively as they shall severally attain the age of one and Twenty yeares by my Executor hereinafter named and in case either of them shall happen to dye before he shall have attained the said age of one and Twenty yeares then my Will is that the survivor of them shall have the whole sume and in case they shall both dye before they shall attain that age then the whole sume of one Thousand pounds to remain to my executor and not be paid Item I give and bequeath unto my cousin Edward Whitchurch of Westcomb my Cousin Edward Whitchurch of Froome and James Wickham the elder of Froome Gent the Sume of one Thousand pounds in Trust to and for the use and benefit of my Grandchildren Roger Leversedge and Mary Leversedge to be equally divided between them and to be paid to each of them respectively as he or she shall attain the age of one and Twenty yeares and my Will is that my said Trustees or the Major part of them or the Survivor of them shall put out the same money or any part thereof at Interest on such Security or Securityes as they or the Survivor of them shall think fit and the Interest thereof to be paid towards the breeding up putting forth or education of my said Grandchildren as my said Trustees or the Major part of them or the Survivor of them shall think fit and in case either of my said Two Grandchildren shall happen to dye before he or she shall have attained the said age of one and Twenty yeares then the Survivor of them shall have the whole and if they shall both dye before they shall attain that age then the whole sume of one Thousand pounds to remain and be paid back to my Executor provided always and it is my Will that in case any Sume or Sumes of money that shall be continued or put out at Interest by my said Trustees or any or either of them shall happen to be lost by insolvent securityes the same or any part thereof shall not be borne or lost by my said Trustees or either of them but by the person or persons for whest not the same shall be declared in such Security or Writing to be and my Will further is that my said Trustees shall not be chargeable the one for the other of them or for the acts defaults or Receipts of the other of them of or concerning any of the premises but each of them only for himself and his own respective Acts Defaults and receipts onely and not otherwise and that they shall deduct and —– in each and every of their lands all such moneys costs damages and expenses as they or any or either of them shall pay expend or be put unto in and about the execution of the aforesaid Trust Item I give unto my Daughter in Law Mrs. Elizabeth Cullyford and her Two Sons John and Samuel Whitchurch Ten pounds apeice to buy them Mourning Item I give to my Neice Mrs. Joanna Glascock the Sume of Three hundred pounds out of which my Will is that shall pay her Mother five pounds a year for and during the natural life of her said Mother Item I give the Interest or yearly profit of one hundred pounds —– children? …poor Women that shall be in the Alms-house in Froome for the time being and —– poor of the said parish of Froome as the same have been —–paid for some yeares past and for which —– there is now A Mortgage for the aforesaid use Item I give the Interest or yearly profit of one hundred pounds owe to me from Christopher Mills and William Ball to the Master of the —– in Froome aforesaid for the teaching of —– such poor children of the said parish of Froome as shall be from time to time nominated and appointed by my Heires Item I give to the vicar that shall be of Froome at the time of my death ten pounds to buy him a —– and pulpit cloth Item I give to the poor of the parish of Froome Ten pounds to be given and distributed to such of them and in such manner as my executor and Trustees shall think fit Item I give ten pounds to the poor of the parish of Nunny to such of them as my Executor shall think fit but in the disposal thereof I desire a respect may be had to my —– workmen Item I give to the poor of the parish of Berrowe ten pounds to be disposed of and distributed as Jeremy Tucker and Ferdinando Board shall think fit Item I give to the poor Tenants within my Mannors of Stalbridge West– and —– five pounds to be disposed of and distributed to such of them and such —– as Thomas Parett and William Lush shall think fit Item I give unto all such as shall be my Domestick servants at the time of my death such Mourning as my Executor and Trustees shall think fit Item I give unto my Sister Rainsford and my cousin Glascock and his Wife ten pounds a peice to buy them Mourning Item I give to my cousin Sturzman? ten pounds Item I give to the said Edward Whitchurch of Westcomb Edward Whitchurch of Froome and James Wickham ten pounds apeice to buy them Mourning and A ring of Twenty Shillings apeice and do nominate appoint and desire them to be Trustees and overseers of this my said Will to see the same performed and it is my Will that whatsoever expense they or either of them shall be at or put unto shall be paid them by my Executor Item I give and devise unto my beloved Grandson William Whitchurch the son of my late Son John Whitchurch deceased all other my Mannors Messuages Lands Tenements and Hereditaments whatsoever (not herein before given or devised) to hold the same unto my said Grandson William Whitchurch his Heires and Assignes for ever Item all other my reall and personal estate chattle Leases Mortgages Bonds Securityes money debts Jewells Plate Household stuff Goods and Chattells whatsoever (not herein before given my debts and Legacyes and what else I shall give by a Codicil to this my Will being paid) I give and bequeath unto my said Grandson William Whitchurch the son of my said son John Whitchurch and do nominate and appoint him to be my whole and sole Executor of this my said last Will and Testament In Witness whereof I the said William Whitchurch have to this my last Will and Testament contained in two sheets of paper set my hand and seale to each of the said sheets the Two and Twentyeth Day of September in the fifth year of the Reign of our Soveraigne Lord George by the Grace of God King of Great Britain France and Ireland Defender of the faith —–Domini 1718 William Whitchurch . This Writing contained in two sheets of paper were each of them signed and sealed by the Testator William Whitchurch and published and declared by his to be his last Will and Testament in our presence and was by us three Witnesses attested and Subscribed in the presence of the said Testator and both of the said sheets of paper were signed by us. Whereas I the above named William Whitchurch Esq. have made my last Will and Testament as is mentoned and contained in these Two sheets of paper I do declare Ratify and confirm the same and I do by this present Codicil give and bequeath unto my Grandson William Whitchurch the eldest son of my son William Whitchurch the summe of four hundred pounds of lawfull money of great Britain to be paid unto him within two yeares after my death and to be raised and paid by his said father out of my Mannors in Berrowe and my Messuages Lands Tenements and Hereditaments in the aforesaid Severall parishes of Berrow Brent and Burnham in the County of Somerset and I desire this codicil may be taken as and for part of my last Will and Testament Witness my hand and seal the Twelfth day of February in the year of our Lord God one Thousand Seven hundred and Eighteen.
