In the Name of God Amen I Francis Whitchurch of the City of Bristoll Esquire of the Aldermen of the same City being of sound and disposing mind memory and understanding and considering with my selfe the certainty of death and the uncertainty of the time thereof do therefore revoking all former Wills make and ordaine this my Last Will and Testamt in manner following First and principally I commend my Soul into the hands of Almighty God that gave it & my body I comitt to the Earth to be decently interred in the pish Church of St Thomas in the said City of Bristoll as near my late wife Sarah who lyes there interred as conveniently it may be And as touching such worldly Estate as God of his infinite mercy hath bestowed upon me I dispose thereof as followeth (that is to say) I do order and appoint the sume of two hundred pounds to be expended on my Funerall at the discretion of my deare and loving wife Elizabeth and my Executors here-after named Item I do give to the use of the poor of the severall parishes of St Thomas and Temple within the said City of Bristoll the sume of ten pounds to each parish the same to be distributed in such manner as my said Extors shall think most convenient Item I do give devise and bequeath unto my Son in Law John Rich of the said City of Bristoll Grocer and to my Nephew Edward Whitchurch of the same City Soapmaker and to their Heires and assignes forever all that my Stable in St Thomas Street in the same City with all its apptences To hold the same unto them the said John Rich and Edward Whitchurch their Heires and Assignes forever not as joynt Tenants but as Tenants in common Item I do give and bequeathe unto my said deare and loving wife Elizabeth the sume of six hundred pounds and all interest due and to be due for the same which sume is secured by Bond of Mr Pledgers in the name of my said wife before our intermarriage And I do also give unto my said wife all my Household Goods and Implemts and Utensills of Household Stuff And all my plate Rings Jewells and Watches saving what are here-after otherwise disposed of And all her Wearing Apparrell Rings Jewells and Ornamts of her person And also whatever moneys she shall have in her own keeping and custody at the time of my death without rendring any account to my Extors for the same Item Item I do give unto my Brother Samuel Whitchurch the sume of one hundred and Fifty guineas in gold and also ten guineas more to buy him mourning Item I do give unto my Cousin John Peach Clothier One hundred pounds and twenty pounds to buy him and his wife mourning Item I do forgive my Cousin Nathaniel Tilly all and whatsoever he now doth and shall owe me at the time of my decease upon any accot(?) whatsoever And I do hereby release and discharge him and his Estate therefrom And I do give unto all the children of the said Nathaniel Tilly by Mary his now wife which shall be living at my decease the sume of twenty pounds apiece Item I do give unto my Nephew Thomas Whitchurch the sume of one hundred pounds Item I do give unto my said Son in Law John Rich for the use of his Neice Sarah Rich daughter of James Rich deced All my Lottery Ticketts which amount to fourteen pounds And for all my interest therein which will continue to the yeare of our Lord God 1712(?) And I also give unto the said Sarah Rich my first Wifes Wedding Ring and her Diamond Ring and Necklace of pearls Item I do hereby give and grant unto my said deare and loving wife Elizabeth for and during the term of her natural life and to be issuing out of my whole Residuary Estate one Annuity or yearly Sume of two hundred pounds cleare of all Taxes charges and other Outgoings and to be paid by four equall quarterly paymts in the yeare to commence from the day of my death And for the better and more certaine paymt thereof accordingly I do hereby order and direct my said Extors hereafter named within twenty days next after my decease to deliver over and assigned unto my very good friends Henry Walter Esquire Mayor of the said City of Bristoll and George Stephens of the same City Esquire one of the Aldermen of the same City the sume of four thousand pounds out of the rest of my Securitys Moneys Chattells and personal Estate such as my said wife and they the said Henry Walter & George Stephens shall approve of In trust to be by them the said Henry Walter and George Stephens and the Survivor of them my said Extors by and with the approba— of my said wife continued and from time to time putt out at interest or otherwise imployed in Trade So that my said wife shall and may thereout by equall quarterly paymts have and receive the said Annuity of two hundred pounds during her life And afterwards In trust that the same sume of four thousand pounds shall go be and remaine unto my said Extors hereafter named equally to be divided between them in like manner as I have hereafter given them my residuary Estate And my will and meaning is that if any Loss or Losses shall happen therein the same shall be borne and paid out of my Residuary Estate it being my desire that the said Annuity shall be paid constantly in manner aforesaid without any loss Neither shall either of them the said Henry Walter and George Stephens be accountable for more moneys than shall actually come to their respve hands And I do give unto them the said Henry Walter and George Stephens ten guineas apiece Item All the rest and residue of my Moneys Securitys for moneys Stock in Trade Bills Bonds Mortgages Chattells and Personalll Estate whatsoever and wheresoever my Debts and Legacys being first paid and Funerall expences discharged I do give devise and bequeath unto them the said John Rich and Edward Whitchurch their Extors and Admers equally to be divided between them share and share alike And I do nominate constitute and appoint them the said John Rich and Edward Whitchurch to be joynt Extors of this my Last Will and Testamt In witness whereof I the said Francis Whitchurch have hereunto putt my hand and seale this one and twentieth day of December Anno – 1715 / Fra: Whitchurch / Signed Sealed Published & Declared by the said Testator to be his Last Will and Testamt in the presence of us who subscribed our names in his presence.
