In the Name of God Amen, I John Whitchurch of Nunney Castle in the County of Somersett Gent being indisposed in body but of sound perfect and good disposeing mind memory and understanding Do make and ordain this to be my last Will and Testament revoking all other and former Wills in manner and form following (that is to say) First I recommend my Soul to God my Creator hopeing for Salvation through the alone Merrits & Mediation of my blessed Saviour Jesus Christ and my body I commit to the Earth to be decently buryed at the discretion of my Executor herein after named and appointed and as to my worldly Estate hereinafter mentioned I give and dispose thereof as followeth Imprs. I give and devise unto my Brother Samuel Whitchurch and to his heirs and Assignes for ever the Tyths of Holworth in the County of Dorsett & all other Tyths arising out of that Parish or elsewhere which I am Interested in or intituled unto To have and to hold the same to him & his heirs for ever Item I give and bequeath unto Jane Barton daughter of Peter Barton of Tiverton(?) in the County of Devon Merchant the Sume of two hundred pounds payable out of the Legacys given me by the Will of William Whitchurch Esq. my late Brother deceased when such Legacies shall be paid to my Executor hereafter named Item I give unto the said Jane Barton my Gold Watch And Lastly I give devise and bequeath unto my said Brother Samuel Whitchurch all my Reall and Personall Estate whatsoever whom I do hereby declare and appoint to be sole Executor of this my last Will & Testament In Witness whereof I the said John Whitchurch have to this my last Will and Testament Sett my hand & Seal this Twenty Eighth day of October in the Thirteenth year of the Reigne of our Sovereigne Lord George by the Grace of God of Great Britain France and Ireland King Defender of the Faith —– —– One Thousand seven hundred and Twenty Six – John Whitchurch – Signed Sealed Published and declared by the said John Whitchurch the Testator to be his last Will and Testament in the presence of us who severally subscribed our names in his presence and at his request_Mabella Gould_Peter Wigley_Ri Willoughby_

On the first day of December in the year of our Lord 1739, Admins with the Will —– of the Goods Chattells and Credits of the said John Whitchurch deced left unadmsed by Samuel Whitchurch the sole Executor and residuary Legatee named in the said Will of the sd. deced now also deced was granted to Mabella Gould Spnt. the administratrix —– the Will annexed of the Goods unadmsted of the said Samuel Whitchurch deced being first sworn only to admst.
